14. Processing a Counter-Notification

When we receive a valid counter-notification, we may provide a copy to the party who submitted the original copyright infringement notice as permitted or required by law.

Where the statutory DMCA process applies, removed material may be restored in accordance with the applicable statutory procedure unless the original claimant informs us that appropriate legal action has been filed to restrain the allegedly infringing activity.

15. False or Misleading Notices

DMCA notices and counter-notifications are legal communications.

Do not knowingly submit:

  • False copyright claims
  • False ownership information
  • Fraudulent authorization information
  • Materially misleading statements
  • False counter-notifications

Under 17 U.S.C. § 512(f), a person who knowingly materially misrepresents that material or activity is infringing, or that material was removed or disabled by mistake or misidentification, may be liable for damages as provided by law.

16. Repeat Infringement

Where appropriate and applicable to services involving user-submitted content, Topulight may take reasonable measures concerning repeat copyright infringement.

Depending on the circumstances, this may include restricting or terminating access to features that permit repeated submission of infringing material.

Any such action will be taken consistent with applicable law and the nature of our services.

17. No Abuse of the DMCA Process

The DMCA process should not be used to:

  • Remove lawful competing content
  • Suppress legitimate criticism
  • Make knowingly false claims
  • Harass another party
  • Misrepresent copyright ownership
  • Improperly interfere with lawful commerce

Copyright disputes should be submitted accurately and in good faith.

18. Trademark and Other Intellectual Property Claims

The DMCA primarily addresses copyright infringement.

Claims involving:

  • Trademarks
  • Service marks
  • Brand names
  • Logos
  • Other non-copyright intellectual property rights

should generally be submitted under our Intellectual Property Claim Policy.

Send those claims to: support@topulight.com

with sufficient information to identify the right and material at issue.

19. Privacy and Claim Information

Information submitted in a DMCA notice or counter-notification may be used to:

  • Review the claim
  • Verify information
  • Contact the claimant
  • Contact the affected party
  • Process a counter-notification
  • Maintain legal records
  • Prevent abuse
  • Establish, exercise, or defend legal rights
  • Comply with applicable law

Because the DMCA process may require communication between the parties, information contained in a notice or counter-notification may be disclosed to the affected party where appropriate or legally required.

Personal information is otherwise handled in accordance with our Privacy Policy.

20. No Legal Advice

This DMCA Policy is provided to explain Topulight's copyright-reporting procedures.

It does not constitute legal advice.

If you are uncertain whether material infringes your copyright, whether an exception applies, or whether you should submit a DMCA notice or counter-notification, you may wish to obtain advice from a qualified legal professional.

21. Relationship to Our Intellectual Property Policy

Other intellectual property complaints may be handled under our Intellectual Property Claim Policy.
